PUBLIC COMMENTS – KENNETH MCBRIDE – Chairman Zach Henderson asked Mr. McBride to address the Board. Mr. McBride stated that around November 2009, Surry-Yadkin Electric Membership Corporation erected a square light on his neighbor’s property facing the highway. He stated the highway runs east and west, and the pole is on the south side of the road. He also stated the light is on the north side of the pole facing traffic. He stated at night he does not need a flashlight to see in his yard. He stated he called the power company and explained the situation to Robert Maxwell, the plant manager. Mr. McBride stated Mr. Maxwell told him he would take care of the problem. Mr. McBride stated Mr. Maxwell sent a gentleman out, and he moved the light. Mr. McBride stated this did not help, so he called Mr. Maxwell again and told him it did not help. Mr. McBride stated he then called the Department of Transportation and spoke to Steve Gentry and Chris Brown who told him it sounded like an encroachment problem. Mr. McBride stated Mr. Gentry and Mr. Brown called Surry-Yadkin EMC, and Surry-Yadkin EMC came out again to work on the light. He stated this time it helped a slight bit, but the light is still facing the road. Mr. McBride stated that twelve to fifteen people on that end of the road go by the light frequently. He stated a lady called him at Christmas and asked him why it was still there. He also stated several people have called Surry-Yadkin EMC. Mr. McBride stated he has talked to Robert Maxwell again, but the light is still facing the highway and is still a problem. Mr. McBride stated school buses run through there in the morning before daylight. He also stated the encroachment law reads, “A homeowner cannot interfere with a neighbor’s property by encroachment or trespassing and cannot undertake activities that create annoying smell, noise, or pollution.” Mr. McBride stated he felt this would include this light because it is shining on the road and in his yard too. Mr. McBride stated he is not interested in having someone get killed in front of his house because of his neighbor’s negligence. He stated his address is still 2362 Poplar Springs Road.
Chairman Henderson stated it appeared Mr. McBride’s main concern is safety. He also stated he did not know what the Board can or cannot do for him, but it will take it into consideration and see if there is something the Board can do. Chairman Henderson stated the Board would let him know.
Mr. McBride stated he is still having problems with the dogs barking too. Chairman Henderson stated he understood and thanked Mr. McBride.
The Wilkes County Board of Commissioners met on Tuesday, January 19, 2010, at 7:00 P.M. with the following members present: Chairman Zach Henderson, Vice Chairman Gary Blevins, Commissioner Keith Elmore, Commissioner Luther Parks, and Commissioner Charlie Sink.
Also present for the meeting were Tony Triplett, County Attorney; County Manager John Yates; and Jodi Hayes Stewart, Acting Clerk to the Board.
The meeting was called to order by Chairman Henderson who welcomed those in attendance.
INVOCATION & PLEDGE OF ALLEGIANCE – The Invocation and Pledge of Allegiance were led by Commissioner Luther Parks.
APPOINTMENT OF ACTING CLERK – Motion was made by Commissioner Charlie Sink, seconded by Commissioner Keith Elmore and unanimously adopted, to approve the appointment of Jodi Hayes Stewart as Acting Clerk to the Board (for the current meeting).
MINUTES – Motion was made by Commissioner Charlie Sink, seconded by Commissioner Keith Elmore and unanimously adopted, to approve the Minutes of the Board Meeting held January 5, 2010.
BUDGET AMENDMENTS - Commissioner Keith Elmore made a motion to approve Budget Amendment No. 31 (Social Services) and No. 32 (Landfill). The motion was seconded by Commissioner Luther Parks and unanimously approved.
TAX DEPARTMENT - EXTENSION OF THE LISTING PERIOD – Alex Hamilton, Tax Administrator, stated North Carolina General Statute Section 105-307 is entitled “Length of Listing Period; Extension; Preliminary Work” and gives the Board of County Commissioners the authority to extend the listing period by thirty (30) days. He stated he is asking the Board to extend the listing period until March 1, 2010. Mr. Hamilton stated the statute also allows the County Commissioners to grant individual extensions of time for the listing of real and personal property upon written request and for good cause shown. He stated the statute allows the Commissioners to delegate this authority to the Tax Administrator. Mr. Hamilton stated the extensions granted under this paragraph shall not extend beyond April 15. He stated he is requesting the Board to delegate the authority to grant the individual extensions above described.
Commissioner Luther Parks made a motion to approve the request with the caveat of changing the date in their information to March 2, 2010. The motion was seconded by Commissioner Charlie Sink and unanimously approved.
PROCLAMATION HONORING SCOUTING VALUES – Chairman Zach Henderson read the proclamation. (Date in proclamation needs to be changed from February to January.)
Vice Chairman Gary Blevins made a motion to approve the proclamation with an amendment to change the date approved from February to January. The motion was seconded by Commissioner Keith Elmore.
Vice Chairman Gary Blevins stated there are two (2) Boy Scouts in attendance tonight. Their names are Cole Wright and Griffin Gieersch with Troop 336. Chairman Henderson welcomed the Scouts.

PROCLAMATION
Honoring Scouting Values
WHEREAS, the Boy Scouts of America has been at the forefront of instilling timeless values in youth since its founding in 1910; and
WHEREAS, this national youth movement has made serving others through its values-based program its mission; and
WHEREAS, the Boy Scouts of America is committed to helping millions of youth succeed by providing the support, friendship, and mentoring necessary to live a happy and fulfilling life; and
WHEREAS, the Old Hickory Council of the Boy Scouts of America and its 330 Cub Scout packs, Boy Scout troops, Venturing crews, Exploring Posts and Learning for Life Groups are celebrating Scouting’s 100th anniversary with the theme “Celebrating the Adventure, Continuing the Journey;” and
WHEREAS, there are more than 200 community organizations that make Scouting available for more than 10,000 youth members in our area who participate in the Scouting program as a means of character building, citizenship training, and personal fitness; therefore, be it
RESOLVED, that we, the Wilkes County Board of Commissioners, designate February 7–13, 2010, as Scouting Anniversary Week and express the appreciation of our citizens to the Old Hickory Council and the Boy Scouts of America for their interest in and dedication to America’s youth.

CLOSED SESSION – Commissioner Charlie Sink made a motion to go into Closed Session to consult with and give instruction to the Board’s attorney with respect to a pending administrative action entitled Appeal of Louisiana Pacific Corporation; to discus matters pertaining to the location or expansion of business in Wilkes County; and to consult with the Board’s Attorney to protect the Attorney-Client privilege. The motion was seconded by Commissioner Luther Parks and unanimously approved.
Motion was made by Commissioner Charlie Sink, seconded by Commissioner Luther Parks, and by unanimous vote adopted to adjourn back into regular session.
